Case Study 01 · Corporate
Transfer pricing query — manufacturing group, Johor
The Situation
A Johor-based manufacturing group with a related-party purchasing arrangement received an IRB query requesting transfer pricing documentation. The group's existing documentation had been prepared internally and had not been reviewed against the current IRB guidelines.
What Was Done
The existing documentation was reviewed against the current guidelines. Gaps were identified and supplementary analysis was prepared. The IRB's likely focus areas were assessed and the response was structured to address those points first, with the supplementary documentation attached.
Outcome
The IRB accepted the response and the supplementary documentation without requesting a field investigation. Timeline from query receipt to resolution: approximately six weeks. The group subsequently retained Tuai Counsel for ongoing corporate compliance advisory.
Case Study 02 · Personal
Departure from Malaysian tax residence — senior professional
The Situation
A senior professional with significant Malaysian-source income and property assets was relocating to Singapore on a long-term basis and needed to understand the tax implications — particularly regarding residency status, RPGT on properties not being immediately disposed of, and any notional disposal issues.
What Was Done
A written analysis was prepared covering the residency position under the ITA, the timing of any deemed disposals, RPGT treatment for retained properties, and the interaction with the Malaysia-Singapore DTA. A departure timeline and recommended sequence of actions were included.
Outcome
The client was able to structure the departure in a sequence that avoided unnecessary tax crystallisation. Two properties were retained rather than disposed of, with the written analysis providing the basis for the decision. No IRB query followed on the subsequent filing.
Case Study 03 · Disputes
IRB field investigation — retail business, Johor Bahru
The Situation
A retail business owner in Johor Bahru received an IRB field investigation notice covering three years of assessment. The business had been filing through an accountant but had not maintained consistent documentation for certain categories of deductible expenditure.
What Was Done
A documentation review was conducted before the IRB's first visit. Available records were organised and the deductibility basis for each expenditure category was assessed. A position was taken that some items would need to be conceded and others were defensible. The IRB interactions were managed with that stratified approach.
Outcome
The matter was settled at the audit stage without escalation to a formal assessment dispute. The agreed additional tax for the three years was below the initial exposure estimate from the IRB's opening position. The matter concluded in approximately five months from the initial notice.
