What does an initial engagement with Tuai Counsel look like?
We begin with a short written description of your matter — either submitted through our contact form or provided by email. A named practitioner reviews the submission and responds with an initial reading of the position, any immediate observations, and a proposal for how the engagement might proceed. There is no charge for this initial written response.
How are fees structured for dispute matters?
Dispute engagements are divided into clear phases: initial review and documentation assessment; response preparation; hearing or appeal representation; and, where necessary, court proceedings. Fees for each phase are agreed before that phase begins. The RM 5,450 opening figure covers the first substantive phase. You are not asked to commit to the full matter at the outset.
My accountant already prepares my tax return. Why would I also need a tax counsel?
A return-preparing accountant and a tax counsel serve related but distinct functions. The accountant calculates and files; the counsel advises on the underlying positions — how income should be characterised, whether a particular relief applies, how a disposal should be treated for RPGT purposes. In some cases we work alongside the existing accountant; in others the mandate is narrower and addresses only those aspects where legal interpretation adds value.
Do you handle matters outside Johor Bahru?
Yes. Tax matters are governed by federal law, and our practice extends across Malaysia. Most advisory work proceeds by written correspondence and document review, so location is rarely an impediment. For hearings before the Special Commissioners or High Court proceedings, we attend in person wherever the hearing is fixed.
How long does a corporate tax compliance engagement typically take?
The annual corporate engagement runs on the company's financial year cycle. We deliver a position note at the start of the year, a mid-year review, and a pre-submission session before Form C is lodged. The total working time across the year is typically four to six weeks of active engagement, spread across three touchpoints.
Is the conversation with my practitioner confidential?
Communications with Tuai Counsel are subject to legal professional privilege where the counsel is advising in their capacity as a legal practitioner. Before engaging, we can clarify the applicable privilege position for your specific matter type. In IRB investigation contexts, this question often has practical importance, and we address it explicitly in the initial review.
